Terms and Conditions
BOOKINGS
Bookings: You must be at least 18 years of age to book a TOP SUN holiday. You must be over 18 years of age to take a Top Sun holiday without a parent or guardian. Anyone under 18 years of age travelling without their parent or guardian will not be accepted.
Price Includes: Accommodation for up to four or six, of which there is a maximum of 4 adults per mobile home; parking for one car; cleaning on arrival; access to pool complex for party members.
Extra guests: Some sites may, at their discretion, allow an extra person in larger mobile homes, for a daily charge payable on site.
Methods of payment: We accept payment by debit card, credit card, PayPal or bank transfer. We do not accept payment by cheque.
Mobile homes: the exact layout of mobile homes can vary as mobile homes are updated frequently. Please note pictures are typical views of the accommodation and you should not expect all units to be exactly the same. The mobile homes use bottled gas: should this run out in the evening a replacement may not be possible before morning.
Bookings: Usually, we start to take bookings for the next season in the summer of the previous season once we have a preliminary agreement with the site in question. In the event that a formal contract should not be signed with the site in the autumn, or the opening dates, or the accommodation offered are not as expected, a full refund is made. If the opening dates are not as expected, we will follow local guidelines about date changes and credit notes.
Payment: You must pay 25% at the time of booking. The remainder is due 10 weeks before arrival. If you book your holiday less than 10 weeks before arrival you must pay the full amount at the time of booking. There is £20/20 Euro booking fee for each booking
The contract: When we receive your 25% deposit, we will confirm your booking in writing and receipt your payment. We will confirm your accommodation and details of anything else you have requested, such as sheets/towels. When your final payment is made, we will issue a receipt and send directions and a check-in voucher to be presented upon arrival. We will always send a receipt for any payment. If you do not receive a receipt you must contact us to confirm that we have received your payment.
Booking amendments: Any changes to your booking, if we agree to them, are charged at £35/35 Euro (double if payment is made after arrival on site) plus the charge imposed by transport providers and/or accommodation price difference. We make no refund if the revised dates are cheaper than the original dates. If you need a “grace period” to the end of the day, whilst you book flights, please contact us and we can usually work with you on this. If you do not pay the final payment within 10 weeks of arrival the holiday is cancelled. Please make a note of the due date as we do not send a reminder. Subsequent re-instatement, if possible, will incur a fee of £35/35 Euro. If any person, not named on the accommodation voucher, is part of your party you will be charged £70/70 Euro at check in if we accept this person. Payment online by card or PayPal may be made for a 3% supplement. There is no supplement for payment by debit card if you pay with us over the phone. There is a charge of £35/35 Euro if documents need to be set to you by post. The booking is only for the people named on the check-in voucher. The £35/35 Euro fee apples to any change to this (double if it is paid after arrival on site). Max 4 adults+2 children in any 3 bed mobile home.
Overpayment: If you overpay your account you will have a credit balance to use against future bookings. Alternatively, we will refund this amount in sterling less a £20 administration fee. Please note Top Sun cannot be responsible for any bank charges involved in cashing this cheque.
Transportation: If we book your channel crossing you agree to be bound by the terms and conditions of the transport company. You must advise us if any party member is in the late stages of pregnancy as travel restrictions differ. No refund is due is you cancel your crossing. Our prices quoted are for a car with a max height of 183 cm and no longer than 5 metres.
Surcharge Guarantee: Once you have a confirmed booking, we will not increase the price due to currency fluctuations.
PRE-ARRIVAL
Travel Advice: If you are UK-based the Foreign and Commonwealth Office may have issued travel advice for your destination. You are advised to check this at the time of booking http://www.fco.gov.uk/
If you are not based in the UK, please refer to the equivalent office for your main country of residence.
Packing: You will require your own sheets and towels (some sites rent sheets or sheets towels and beach towels on site)
Countryside: The sites are in the country. You should be aware that country fauna and flora will be present. This could include ants, field mice etc.
Arrival: The accommodation is booked from 4pm. Clients who alert us to a possible early arrival are welcome to arrive from 12 noon and will be given access to the facilities such as swimming pools etc, until their mobile home is ready at 4pm.
UPON ARRIVAL & DURING YOUR STAY
To Pay Locally:
Taxe de Sejour (not the same at every site but typically 66 centimes per person (over18) per day)
Damage Deposit: 200 Euros (most sites) refunded on departure if client checks-out at the designated date and time.
Optional Extras: Sheets and towels payable on site if available.
Campsite: You agree to be bound by the rules and regulations of the campsite. We may give your contact details to the campsite if they make an individual specific request. This is usually to contact a client about something left in a mobile home. The campsite operates a wristband policy will not give access to guests to any part of the campsite (mobiles or any of the facilities).
Pets: One dog per mobile home is accepted). Dogs (except for the 1st and 2nd category) that are vaccinated are allowed. You must bring proof of vaccination. Dogs must always be on a lead and must not be left alone in the mobile home
Swimming pools: you should take note of local procedures regarding swimming pools: a lifeguard may not be on duty. Please note a swimming pool may not be open early or late season.
Our Responsibility: We accept responsibility for all the parts of your booking made with us. If any part is not provided as promised, and if this has affected the enjoyment of your holiday we will, at our discretion, pay you appropriate compensation. You are required to give us the opportunity to address your problem while you are still at the resort.
Your Responsibility: Any clients who infringe site regulations or local laws or who upset the enjoyment of other clients may be evicted from their accommodation and be required to find other accommodation at their own expense. When you receive confirmation documents from us you must check that the location, type of accommodation, arrival and departure dates and any ferry details are correct. We try very hard not to make mistakes and we will do all we can to correct them, but you must alert us to any mistakes before you arrive on site. If you have a complaint you must allow us the opportunity to solve it while you are on holiday. If you are not satisfied you must write to us within 14 days of the end of the holiday. Top Sun is unable to respond to complaints before the end of the campsite season.
UPON DEPARTURE
Departure: departure is between 9am and 10am.
Cleaning on departure if accommodation is not left perfectly clean. Current rates available on request.
FURTHER FINANCIAL INFORMATION
Refunds: If we cancel your maximum refund is limited to the amount you have paid.
Climatic Conditions: we will not refund for holiday interruption due to climatic conditions or power failure. You are advised to insure against this risk. In exceptional circumstances, refunds are given at the discretion of the management.
Industrial Action etc: Top Sun is not responsible for any loss resulting from industrial action, failure of utilities or loss resulting from severe weather or natural disaster.
Cancellation: If you cancel your booking, or we have to cancel it because you have not paid promptly, you will have to pay a cancellation charge. This charge is the 25% deposit if you cancel more than 10 weeks before arrival. Less than 10 weeks before arrival the charge is a percentage of the cost of the holiday (plus any bank fees we have paid to receive your money) The booking fee is non-refundable.

HOLIDAY PROTECTION: Top Sun complies with the European Union package travel directive to protect your holiday. Client monies are kept in a trust fund until you return from your trip. Only then does TOP SUN LTD have access to your money.
COMPLAINTS
If you have a complaint you must tell our on-site agent immediately. If we cannot resolve your problem in the resort you must contact us in London. Outside office hours our number is 079 84 15 96 37; messages are picked up regularly. If we cannot resolve the problem, you must write to our London office within 14 days of your return. Top Sun cannot respond to complaints in July and August.
Jurisdiction: This contract is covered by the laws of England. No contract is created until the first payment has been made.
PRIVACY STATEMENT
Introduction
Under the 1988 Data Protection Act (DPA), Privacy and Electronic Communications (EC Directive) Regulations 2003 (SI 2003/2426) (Privacy Regulations) and the General Data Provisions Regulations (GDPR) your data controller is: TOP SUN LTD (referred to in this Notice as "we" or "us").
We are committed to ensuring that the privacy of your information is protected always. This policy explains how we collect information about you, how we use the information we collect and how you can instruct us, if you prefer to limit the use of your information and procedures that we have in place to safeguard the privacy of your information.
By using our services (including booking a holiday or enquiring through our websites) you acknowledge that we can collect and use your information as described in this Policy. Protecting your privacy is important to us and we aim to be as clear as possible about how your information is used. If you have any questions about this, or wish to withdraw your consent at any time, contact us using the details in the section: Data Protection and Your Privacy.
Please read this Privacy Policy carefully before submitting any of your information to us. Some of the ways we use your information are necessary for us to provide our services to you, and others will only be used with your consent.
When Changes are made
If we change our Privacy Policy and/or any procedures that involve the information that you have provided to us, we will post those changes on our websites. This will ensure you are aware of current information collection methods, uses for that data as well as under what circumstances we may disclose it. Your continued use of our services (including our websites and apps) after this Privacy Policy has been amended shall be deemed to be your continued acceptance of the terms and conditions of this Policy, as amended. We encourage you to bookmark this page and review this Privacy Policy at regular intervals.
Users of our Services
Our online bookings service and the online functions of our websites are only intended for users aged 13 years and over, so please do not use them if you are under 13 years old. As part of the booking process, we will ask for the age and/or date of birth of any persons under 18 years of age within the party. This information is collected so that we can ensure that access to age restricted services (i.e. kids’ clubs, capacity restrictions) are appropriately adhered to. This information is not used for any other purpose.
By using our websites and by providing us with your information, you acknowledge that we may collect and use your information in accordance with this Privacy Policy. Where you submit information to us through our websites, or when you contact us, you confirm that, where you are providing details on behalf of someone else you have permission to do so and that you have read, and agree to, the terms of our Privacy Policy.
Data Protection and Your Privacy
Data Security: While the nature of the Internet is such that we cannot guarantee the security of the information you transmit to us via the Internet, we follow strict security procedures in the storage and disclosure of your information, to prevent unauthorised access or any loss of your information. Our security procedures mean that we may occasionally request proof of identity from you before we can discuss your account details or other queries.
Top Sun and all 3rd parties where your information is shared will take full responsibility for ensuring that the most appropriate security measures are in place to protect your information.
Marketing: Where you have given us your consent, we will use your information for some marketing purposes to contact you from time to time regarding offers or news that we think you might be interested in.
Data Storage: we will store and use your information for a set period. We will cease to use your information for marketing purposes 10 years from the point of last interaction (e.g. your last booking with us or last email activity etc.,) or from the point you request us to stop using your information for marketing purposes, whichever is sooner. At this point, your information is then minimised and only used for analysis.
Data Profiling: Data profiling is used to continually improve the offerings of Top Sun products, services, communications etc. We will use your information to collate statistics or informative summaries about topics such as (but not limited to) customer behaviours, booking patterns and trends etc. We may, for example, send marketing emails based on any findings, for example sending you marketing emails with content related to a previous holiday you have booked.
Your right to delete or rectify your information or object to your information being used: You are always in complete control of how we use your information. Where you have consented to us using your information for purposes as set out in this Privacy Policy (for example asking us to store your email address to receive a quote), you can withdraw your consent at any time, by contacting us on by email [email protected]. Where you ask us to stop marketing communications, please be aware it may take us up to 5 days to ensure our systems are updated.
You are always entitled to see what information is held about you. If you want to find out what information we hold about you (called a Subject Access Request) or to have any of your information updated or corrected, please email [email protected]. There is no charge for single subject access requests, however we may make a small charge for multiple copies. Proof of I.D. will be required. All requests will be fulfilled within 30 days.
Please note: if you do unsubscribe from promotional contacts, you will still receive essential calls, SMS text and email communications specifically relating to a booking you have with us.
Legitimate Interests: if you book a holiday or request a quote, we believe that we can demonstrate that we have a legitimate interest in using your information for some marketing purposes, such as sending you information of our special offers, however you always have a choice. Nevertheless, if you do want to receive communications from us, for example our next season’s prices, please let us know directly or by clicking to Unsubscribe when you receive these emails.
The Right to Lodge a Complaint: You are always in control of your information and we will always strive to achieve the highest standards in how we collect, used and share your information. If you feel that we have not handled your information as set out in this Privacy Policy or in other related statements, you have a right to complain to the Information Commissioners Office (ICO). The ICO can be contacted by visiting https://ico.org.uk/concerns/ or calling +44 (0)303 123 1113 where you can report your concerns.
What information do we collect and how do we use it?
We collect information from you:
When you navigate the website, search for, price up and book a holiday and other related products and services from us; if you interact with our Social Media pages (e.g. Twitter or Facebook); if you contact us for a quote (by email/phone); we will need to know some details about you such as your name, email address, telephone number (mobile or landline) and payment card details. If you contact us or have an enquiry, we will keep a record of this which may include some of your information depending on how you contacted us.
We use the information you provide us: To provide a high-quality service to you; To improve our services for you and to tailor our products and services to your requirements; To supply our agents and sub-contractors who are working on our behalf with the required information to process and fulfil your booking and to send you service-related emails and text messages for your booking. We will also use these details to send you a follow-up email after your holiday, to check that you were satisfied with your holiday. We may collect more, or less Information from you depending on which source we collect it from and which services you are using.
Sharing Information with 3rd Parties
We may need to pass some of this information on to 3rd parties for example, suppliers of your travel and holiday arrangements such as ferry operators, the campsite, etc. The following details where we share your information. A full list of the individual companies is available on request.
These 3rd parties include:
Travel Partners: if your booking includes a ferry/channel crossing, then your personal information will be shared with the relevant travel partner on your booking, for example Eurotunnel or P&O Ferries.
Payment Partners: your information is shared to process payments for you holiday. Our payment partners are WorldPay and PayPal
Local Partner: your information is shared with the relevant campsite/accommodation provider to facilitate the accommodation element of your booking.
Where a duty exists: If we are under a duty to disclose or share your personal information in order to comply with any legal obligation and/or in order to enforce or apply any other agreements between you and us (for example, debt collection agencies).
Legal Requirements: Where we are obliged to, or permitted to do so, by law, court order, search warrant or similar presented to us by any law enforcement or government officer.
These companies are all based within the European Union, except for the likes of our payment mechanisms such as PayPal who will store your information in the European Union and the United States of America.
If our business is sold or integrated with another business your information may be disclosed to our advisers and any prospective purchasers' advisers and will be passed on to the new owners of the business.
3rd Party Payments
When you make a payment by PayPal, or similar payment solution, by clicking on the proceed to payment button, you understand and agree that: (i) you will be leaving the our website and will be transferring to their payment platform, (ii) any your information you enter shall be subject to their own privacy policy, (iii) your information may be processed and stored outside of the European Union and (iv) they shall be responsible for all processing of your information.
Links to External Websites
Our websites may link to a number of external websites, for example Facebook. If you click on one of these links you acknowledge that your access of such websites will be subject to that website's own terms and conditions and Privacy Policy.
We have no control over how your information is used by these websites, where it is stored and, as such, any course of action you have regarding any alleged misuse of such information must be against the owners of the relevant website. You acknowledge that the same information may be provided by you to both that website and us, but only when specifically provided to us is it subject to this Privacy Policy.
